Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of portfolioplaza.com and PortfolioPlaza websites, tools, content, beta programs, portfolio services, AI-assisted services and other products or features.

In these Terms, "PortfolioPlaza," "we," "us," and "our" refer to the operator of PortfolioPlaza in India.

By accessing or using PortfolioPlaza, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must have the legal capacity to enter into these Terms.

PortfolioPlaza's personalized image-upload, portfolio-generation and paid services are intended only for persons aged 18 or older, unless PortfolioPlaza expressly introduces a different lawful eligibility process.

By submitting photographs or purchasing a personalized service, you confirm that you are at least 18 years old.

2. What PortfolioPlaza Provides

PortfolioPlaza may provide services and resources including:

• educational guides and articles;
• free portfolio tools;
• beta and early-access programs;
• portfolio planning and creation;
• portfolio review;
• portfolio PDFs and presentation assets;
• AI-generated portfolio imagery;
• modeling, architecture, fashion-design or other professional portfolio services;
• agency or application-preparation tools;
• comp cards and similar assets;
• image review or technical guidance;
• digital downloads; and
• other portfolio or career-presentation tools.

PortfolioPlaza may add, modify, suspend or discontinue features from time to time.

A feature shown as beta, preview, waitlist, coming soon or unavailable is not represented as a currently deliverable paid service unless checkout or another clear purchase mechanism is enabled.

3. PortfolioPlaza Is Not an Agency, Employer or Admissions Body

PortfolioPlaza is not a modeling agency, talent agency, recruiter, employer, university, architecture licensing authority, fashion school, casting director or professional accreditation body.

PortfolioPlaza does not guarantee:

• modeling or talent representation;
• casting;
• employment;
• admission to a school or university;
• internship placement;
• client work;
• professional licensing;
• ranking or search visibility;
• acceptance of a portfolio;
• earnings; or
• any other career, educational or commercial outcome.

Requirements differ between agencies, employers, institutions, platforms and jurisdictions. You are responsible for verifying the requirements that apply to your intended use.

4. Accounts and Order Links

PortfolioPlaza may provide services without requiring a conventional customer account.

Where secure order links, tokens or private URLs are provided, you are responsible for keeping them confidential and for notifying us if you believe they have been compromised.

You must not attempt to access another customer's private order, files or administrative areas.

5. Purchases and Pricing

When paid services are enabled, the price, currency, core deliverables and material limitations of the selected package will be displayed before purchase.

Unless otherwise stated, prices may be displayed in US dollars (USD).

PortfolioPlaza may change pricing for future purchases at any time.

A purchase is not complete until payment has been successfully confirmed by the applicable payment processor.

You are responsible for taxes, duties or other charges that apply to your transaction unless they are expressly included or collected by PortfolioPlaza.

6. Custom Services and Customer Cooperation

Certain services are customized and require you to submit photographs, designs, measurements, instructions or other information.

You are responsible for providing information and source materials of sufficient quality and accuracy to perform the requested work.

Delivery estimates may begin only after PortfolioPlaza has received the information and materials reasonably necessary to start production.

Failure to provide required materials may delay or prevent fulfillment.

7. Your Photographs, Designs and Other Materials

If you upload photographs, images, drawings, designs, documents, logos or other material ("Customer Materials"), you represent and warrant that:

• you own the Customer Materials or have sufficient rights and permissions to use them;
• you have any permission required from identifiable persons depicted in the material;
• the material does not unlawfully infringe copyright, trademark, privacy, publicity or other rights;
• the material is not unlawful; and
• your requested use of the material through PortfolioPlaza is lawful.

You retain the rights you already hold in your original Customer Materials.

You grant PortfolioPlaza and the service providers acting on our behalf a limited, non-exclusive right to host, copy, transmit, process, modify and use Customer Materials only as reasonably necessary to:

• provide the requested service;
• generate or assemble deliverables;
• maintain and secure the service;
• provide customer support;
• resolve disputes or abuse; and
• comply with law.

PortfolioPlaza does not obtain ownership of your original photographs merely because you upload them.

8. AI-Generated and AI-Assisted Images

PortfolioPlaza may create photorealistic, stylized or otherwise synthetic images using artificial intelligence.

AI-generated imagery may depict:

• clothing;
• styling;
• poses;
• lighting;
• backgrounds;
• locations;
• scenes;
• physical details; or
• other visual characteristics

that did not exist in the original photograph or in real life.

AI output may contain artifacts, inconsistencies or unexpected differences.

PortfolioPlaza may attempt to preserve recognizable identity and requested characteristics but does not guarantee perfect facial, body, hair, clothing or other identity consistency.

You are responsible for determining whether a generated image is suitable for your intended use and whether disclosure of AI generation is required by law, platform policy, agency rules, employer requirements or other applicable standards.

9. Digitals, Polaroids and Authentic Application Photos

Some modeling agencies and other recipients require genuine, current and minimally edited photographs.

AI-generated portfolio imagery must not be assumed to satisfy a requirement for authentic digitals, Polaroids, identification photographs or other authenticity-sensitive submissions.

Where PortfolioPlaza provides guidance, validation or packaging for such materials, the purpose is to help organize or technically review the customer's real photographs unless expressly stated otherwise.

PortfolioPlaza does not guarantee that an agency or recipient will accept any photograph or portfolio.

10. Rights in Final Deliverables

Subject to:

• applicable law;
• the rights in Customer Materials;
• third-party provider terms; and
• any limitations disclosed with a product,

PortfolioPlaza grants the purchasing customer the rights PortfolioPlaza is able to grant in final custom deliverables for lawful personal and commercial portfolio use.

AI-generated content may not qualify for copyright protection in every jurisdiction.

Generated output may not be unique or exclusive, and similar or identical output may be produced for another user.

Nothing in these Terms transfers ownership of PortfolioPlaza software, templates, branding, systems, prompts, source code, website design or other PortfolioPlaza-owned intellectual property.

11. Prohibited Uses

You must not use PortfolioPlaza to:

• violate applicable law;
• infringe copyright, trademark, privacy, publicity or other rights;
• upload another person's images without appropriate authorization;
• create non-consensual deceptive or impersonation imagery;
• create fraudulent identity documents or materials;
• create or distribute exploitative sexual content;
• create sexual or exploitative content involving minors;
• harass, threaten, defame or abuse another person;
• commit fraud or misrepresentation;
• bypass access controls or security measures;
• probe, scrape or attack restricted systems in an abusive manner;
• access another customer's private files or order data;
• interfere with PortfolioPlaza infrastructure;
• distribute malware; or
• use PortfolioPlaza in another unlawful or materially harmful way.

PortfolioPlaza may refuse, suspend, cancel or terminate access where reasonably necessary to address prohibited activity, fraud, security risk, legal risk or material breach of these Terms.

12. Delivery and Revisions

The package displayed at purchase determines the expected deliverables and included revisions.

Delivery times are estimates unless PortfolioPlaza expressly states otherwise.

AI or customized creative work can require additional generation, review or manual processing.

If a package includes a revision or regeneration, you must provide reasonable, specific feedback related to the purchased deliverable.

A revision does not automatically entitle you to a completely different product, unlimited generations or work outside the package purchased.

13. Cancellations, Refunds and Remakes

Because PortfolioPlaza may provide customized digital services and may incur processing or production costs soon after an order begins, refund eligibility depends on the circumstances and status of the order.

Before custom work materially begins

If you request cancellation before PortfolioPlaza has materially begun custom production or incurred material non-recoverable processing for your order, PortfolioPlaza will ordinarily provide a full refund.

After custom work begins

Once material custom production, AI generation, manual portfolio work, image processing or review has begun, the order may no longer be eligible for automatic cancellation.

Where a package includes a revision or regeneration, PortfolioPlaza may first use that process to address reasonable quality concerns.

Material failure to provide the purchased service

If PortfolioPlaza is unable to deliver the materially described service, or the deliverable has a material defect that cannot reasonably be corrected using the included remedy or revision process, PortfolioPlaza may provide an appropriate remake, credit or refund.

Subjective preferences

Creative and AI-generated work necessarily involves interpretation and variation.

A preference for different styling, posing, expression or creative direction does not automatically entitle a customer to unlimited regeneration or a refund after the purchased custom service has been substantially provided.

Third-party rejection

A modeling agency, employer, educational institution, client or other third party rejecting or declining to use a PortfolioPlaza-created asset does not by itself establish that PortfolioPlaza failed to provide the purchased service.

Duplicate or erroneous charges

Verified duplicate charges or payment-processing errors will be corrected or refunded.

How to request a refund

Contact support@portfolioplaza.com with your order reference and a clear explanation of the issue.

Where practical, requests relating to quality or delivery should be made promptly after delivery so that we can investigate and, where appropriate, provide a revision, remake or refund.

Nothing in this section excludes or limits rights or remedies that cannot legally be excluded under applicable consumer law.

14. Chargebacks and Payment Disputes

If you believe there is a billing error or material service problem, we encourage you to contact support@portfolioplaza.com first so we can investigate.

Nothing in these Terms removes any lawful right you have to dispute a charge through your payment provider.

PortfolioPlaza may provide transaction, delivery, communication and service records to payment providers where reasonably necessary to respond to a payment dispute.

15. Free Tools, Guides and Informational Content

Articles, guides, templates, calculators, portfolio examples, free tools and other informational content are provided for general informational purposes.

They do not constitute legal, financial, employment, admissions, agency-representation or other regulated professional advice.

PortfolioPlaza attempts to provide useful information, but requirements and industry practices change.

You should confirm current requirements directly with the relevant agency, employer, university, institution, professional body or other recipient before relying on PortfolioPlaza content for an important submission.

16. Beta and Early-Access Programs

PortfolioPlaza may invite users to join a beta, waitlist or early-access program.

Joining a waitlist:

• does not guarantee access;
• does not guarantee a launch date;
• does not create a right to any specific future feature; and
• does not require PortfolioPlaza to launch a particular product.

Information submitted through beta forms will be handled according to the Privacy Policy.

17. Analytics and Advertising

PortfolioPlaza may use analytics, attribution and advertising providers to understand usage, measure conversions and promote PortfolioPlaza.

Use of personal information for those activities is described in the Privacy Policy.

Where consent or an opt-out is legally required, PortfolioPlaza will provide or honor the applicable mechanism.

18. PortfolioPlaza Intellectual Property

The PortfolioPlaza name, branding, website design, software, source code, tools, original written content, interfaces, templates, workflows and other PortfolioPlaza-owned material are protected by applicable intellectual-property laws.

Except where expressly allowed, you may not:

• copy;
• reproduce;
• redistribute;
• resell;
• sublicense;
• scrape for commercial republication;
• reverse engineer restricted functionality; or
• create derivative commercial services from PortfolioPlaza-owned material

without permission.

This restriction does not limit rights you have in your own Customer Materials or rights expressly granted in purchased deliverables.

19. Feedback

If you voluntarily provide suggestions or feedback about PortfolioPlaza, you allow us to use that feedback to improve or develop PortfolioPlaza without an obligation to compensate you, provided we do not publicly identify you as the source without permission.

20. Third-Party Services and Links

PortfolioPlaza may rely on or link to third-party providers, including providers of:

• cloud infrastructure;
• payment processing;
• analytics;
• advertising;
• email;
• AI generation; and
• external portfolio, agency, employment or educational resources.

Third-party products and websites are governed by their own terms and policies.

PortfolioPlaza is not responsible for an independent third party's content, decisions, availability or conduct merely because PortfolioPlaza links to or integrates with that provider.

21. Availability and Changes to the Service

PortfolioPlaza may modify, suspend or discontinue a feature where reasonably necessary.

We do not guarantee that every feature will be continuously available or error-free.

Maintenance, provider failures, internet outages, security incidents or events outside our reasonable control may interrupt service.

22. Disclaimer of Warranties

To the maximum extent permitted by law, PortfolioPlaza and its services are provided on an "as available" basis.

PortfolioPlaza does not warrant that:

• every generated image will be artifact-free;
• every portfolio will meet every recipient's requirements;
• the website will operate without interruption;
• all third-party services will remain available; or
• use of PortfolioPlaza will result in representation, employment, admission, business, clients or income.

Nothing in these Terms excludes warranties, statutory guarantees or consumer rights that cannot lawfully be excluded.

23. Limitation of Liability

To the maximum extent permitted by applicable law, PortfolioPlaza will not be liable for indirect, incidental, special, exemplary, punitive or consequential losses arising from use of the service, including loss of opportunity, anticipated income, reputation, business or a third party's decision not to accept a portfolio.

Where PortfolioPlaza's liability relating to a particular paid service cannot otherwise be excluded, PortfolioPlaza's aggregate liability relating to that service will not exceed the amount actually paid to PortfolioPlaza for that service, except to the extent applicable law requires otherwise.

Nothing in these Terms limits liability where such limitation is prohibited by law.

24. Indemnity

To the extent permitted by law, you agree to indemnify and hold PortfolioPlaza harmless against third-party claims, losses and reasonable costs arising from:

• Customer Materials you submit;
• your infringement of another person's rights;
• your unlawful or prohibited use of PortfolioPlaza; or
• your material breach of these Terms.

25. Termination

You may stop using PortfolioPlaza at any time.

PortfolioPlaza may suspend or terminate access where reasonably necessary because of:

• material breach of these Terms;
• fraud;
• abuse;
• security risk;
• unlawful use;
• payment fraud; or
• a legal requirement.

Provisions that by their nature should survive termination, including intellectual-property, payment, liability, dispute and customer-material provisions, will continue to apply as appropriate.

26. Governing Law and Disputes

These Terms are governed by the laws of India, without depriving consumers of mandatory rights that apply to them under applicable law.

Before beginning formal proceedings, you and PortfolioPlaza should make a reasonable good-faith attempt to resolve the dispute directly.

Unresolved disputes will be subject to the jurisdiction of courts of competent jurisdiction in India, except where mandatory applicable consumer law provides otherwise.

27. Changes to These Terms

PortfolioPlaza may update these Terms when the service, business model, providers or applicable law changes.

The latest Terms will be posted on PortfolioPlaza with the current effective date.

Where required, material changes may be accompanied by additional notice or renewed acceptance.
